When your priority date is older than or equal to the current Visa Bulletin Final Action Date, your visa is current. For queued dates, position is estimated proportionally along the active backlog window from the current cutoff to today. Backlog counts are baseline estimates based on USCIS I-485 quarterly inventory reports. The baseline ~9,940 annual cap reflects the statutory 7% per-country limitation under INA §202(a)(2) applied to the 140,000 worldwide employment-based limit under INA §201(d); actual Department of State annual allocations fluctuate based on family-preference spillovers and worldwide demand.
